Data protection is of particular importance for the management of Siehec GmbH, operator of the “AgreeDo” service (at https://www.agreedo.com, hereinafter AgreeDo).

The following notes provide a simple overview of what happens to personal data when users visit AgreeDo’s website. Personal data are all data with which users can be personally identified. Detailed information on the subject of data protection is explained in the data protection declaration listed below.

Legal basis

The processing of personal data, such as the name, address, e-mail address or means of payment (e.g. credit card) of a user, is always carried out in accordance with the basic data protection regulation and in accordance with the country-specific data protection regulations applicable to AgreeDo. AgreeDo would like to inform the public about the type, scope and purpose of the personal data collected, used and processed by AgreeDo by means of this data protection declaration. Furthermore, users are informed of their rights by means of this data protection declaration.

User rights

Users have the right to receive information about the origin, recipient and purpose of their stored personal data free of charge at any time. Users also have the right to request the correction, blocking or deletion of this data. Users can contact AgreeDo at any time via the address given in the imprint as well as for further questions on the subject of data protection. Furthermore, users have a right of appeal to the competent supervisory authority.

Furthermore, the user has the right to have data which AgreeDo processes automatically on the basis of the user’s consent or in fulfillment of a contract handed over to him or to a third party in a common, machine-readable format. If the user requests the direct transfer of the data to another person responsible, this shall only take place to the extent that this is technically feasible and feasible with justifiable effort.

Security through SSL or TLS encryption

AgreeDo uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or requests that users send to AgreeDo. Users recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in the browser line.

If SSL or TLS encryption is activated, the data that users transmit to AgreeDo cannot be read by third parties.

Duty to provide personal information when using AgreeDo

To use AgreeDo, authorization with login (i.e., a user’s e-mail address) and password is required. This is necessary to make the meeting information only accessible to other users desired by the user. If the user is not willing to do so, he cannot use the AgreeDo service for the reasons mentioned above. So-called “public meetings” are an exception. A user can use meeting content from so-called “public meetings” even without entering a login and password. However, the above restrictions apply to all other functions AgreeDo.

Cookies

If the security settings in the user’s browser permit this, the browser may store so-called “cookies” on the user’s computer during a visit to the AgreeDo website. Cookies enable the recognition of the browser.

On the one hand, AgreeDo uses cookies to simplify the use of AgreeDo: Users do not have to enter their login and password every time they visit AgreeDo. Furthermore, the preset user language is also stored using cookies: AgreeDo uses WPML (OnTheGoSystems Limited, 22/F 3 Lockhart Road, Wanchai, Hong Kong, https://onthegosystems.com, https://wpml.org/home/contact-us/) to translate content. WPML uses cookies to identify the visitor’s current language, the last visited language and the language of users who have logged in.

On the other hand AgreeDo uses cookies for marketing and optimization purposes. The user behaviour of visitors to the AgreeDo website is recorded and statistically evaluated using cookies. AgreeDo uses technologies from the following providers:

  • Matomo. This website uses the open source software Matomo (Innocraft Inc., 150 Willis St, 6011 Wellington, New Zealand, https://www.innocraft.com/ and https://matomo.org/ formerly Piwik) for statistical analysis of visitor access. Matomo uses so-called “cookies”. These are text files that are stored on the user’s computer and enable an analysis of the use of the website. For this purpose, the information generated by the cookie about the use of this website is stored on the AgreeDo server. The IP address is made anonymous before it is saved.

    Matomo cookies remain on your device until the user deletes them.

    Matomo cookies are stored on the basis of Art. 6 para. 1 lit. f DSGVO. AgreeDo has a legitimate interest in anonymized analysis of user behavior in order to optimize the service.

    The information generated by the cookie about the use of this website will not be passed on to third parties. Users can prevent the storage of cookies by setting their browser accordingly. AgreeDo points out, however, that users may not be able to use all functions of AgreeDo in this case.

    If a user does not agree to the storage and use of his data, users can deactivate the storage and use here.

    In this case, an opt-out cookie is stored in your browser which prevents Matomo from saving usage data. If users delete their cookies, the Matomo Opt-Out cookie will also be deleted. In this case the opt-out must be reactivated the next time you visit AgreeDo.

Logfile

AgreeDo automatically collects and stores information in so-called server log files, which the user’s browser automatically transmits to AgreeDo. These are:

  • Date, time and time zone of the request to the server
  • Full IP address and hostname of the accessing computer/deviceBrowser type and browser version
  • Operating system used
  • Referrer URL
  • Called page or file with size and transfer status

These data are not combined with other data sources. The storage of this data takes place against the background that only in this way the misuse of AgreeDo can be prevented and this data enables the investigation of committed crimes if necessary. In this respect, the storage of this data is necessary to secure the operation of AgreeDo.

The basis for data processing is Art. 6 para. 1 lit. f DSGVO, which permits the processing of data for the fulfillment of a contract or pre-contractual measures.

Registration of new users

When registering on the AgreeDo website, personal data is collected. Which personal data is transmitted is determined by the respective input mask used for registration. The personal data entered by the user will be used exclusively for the following purposes

  • Use of AgreeDo (e.g. login)
  • Processing of payment transactions
  • Check for spam registrations (see the “Third Party Services” section below)
  • Submission of the newsletter

Newsletter

AgreeDo informs its users at irregular intervals by means of a newsletter about current information regarding AgreeDo.

If the user wishes to receive the newsletter offered on the website, AgreeDo needs the user’s e-mail address and information that allows AgreeDo to verify that the user is the owner of the e-mail address provided and agrees to receive the newsletter. Further data will not be collected or only on a voluntary basis. AgreeDo uses this data exclusively for sending the requested information and does not pass it on to third parties.

The data entered is processed exclusively on the basis of the user’s consent (Art. 6 para. 1 lit. a DSGVO). The user can revoke his consent to the storage of the data, the e-mail address as well as their use for sending the newsletter at any time, for example by clicking on the “Unsubscribe” button in the newsletter. The legality of the data processing processes already carried out remains unaffected by the revocation.

The data stored by the user for the purpose of newsletter subscription at AgreeDo will be stored by AgreeDo until you unsubscribe from the newsletter and deleted after you unsubscribe from the newsletter. Data stored by AgreeDo for other purposes (e.g. e-mail addresses for the AgreeDo service area) remain unaffected by this.

Contact option via the website

Due to legal regulations, the AgreeDo website contains information that enables quick electronic contact (e.g. by e-mail). If a user contacts AgreeDo by e-mail or via the feedback form (https://www.agreedo.com/feedback.html), the personal data transmitted by the user (e.g. e-mail address) is automatically stored. Such personal data voluntarily transmitted by the user to AgreeDo will be stored exclusively for the purpose of processing the user request. This personal data is not passed on to third parties.

Routine deletion of personal data

Personal user data will be deleted at the latest on expiry of the calendar year following the termination of the contractual relationship unless there are special reasons to the contrary in individual cases (European Directive and Regulation Givers or applicable laws or regulations of other relevant legislators). Insofar as the user has raised objections to the amount of the service charges stated in the invoice, the billing data may be stored until the objections have been finally clarified.

Furthermore, personal user data can remain stored for up to two years, provided that complaints processing and other reasons for a proper handling of the contractual relationship require this. Furthermore, the deletion of inventory and accounting data may be omitted insofar as this is provided for by statutory regulations or the pursuit of claims requires this.Data of users whose account has been duly terminated will be deleted. Data of users who have not clicked the confirmation link (see Double-Opt in) within 30 days will also be deleted.

If the storage purpose ceases to apply or if a storage period prescribed by the European Directive and Regulation Giver or another competent legislator expires, the personal data is routinely blocked or deleted in accordance with the statutory provisions.

Forwarding of personal user data to third parties

Services of third parties are used for the provision of AgreeDo. Below is a list of the purposes and names of each service provider. The basis for data processing is Art. 6 para. 1 lit. f DSGVO, which permits the processing of data for the fulfillment of a contract or pre-contractual measures.

Google Services

All Google services mentioned on this page are provided by Google Ireland Gordon House, Barrow Street, Dublin 4, Irland and/or Google Inc. 1600 Google Inc., Amphitheatre Parkway, Mountain View, CA 94043, USA (”Google”).

You can prevent participation in various Google services in several ways: a) by adjusting your browser software accordingly, in particular, the suppression of third-party cookies results in you not receiving any third-party ads; b) by disabling the cookies for conversion tracking by setting your browser to block cookies from the domain ”www.googleadservices.com”, https://adssettings.google.com, although this setting will be deleted if you delete your cookies; c) by deactivating the interest-based advertisements of the providers that are part of the ”About Ads” self-regulation campaign via the link https://www.aboutads.info/choices, although this setting will be deleted if you delete your cookies; d) by permanent deactivation in your Firefox, Internet Explorer or Google Chrome browsers under the link https://www.google.com/settings/ads/plugin, e) by setting your cookie preferences accordingly. In this case, AgreeDo may not be able to use all features of this offer in full.

GOOGLE ADS (FORMERLY GOOGLE ADWORDS)

AgreeDo uses the offer of Google Ads, in order to draw attention to our attractive offers with the help of advertising (so-called Google Ads) on external web pages. In relation to the data of the advertising campaigns, AgreeDo can determine how successful the individual advertising measures are. AgreeDo is interested in showing you advertisements that are of interest to you, to make our website more interesting to you and to achieve a fair calculation of advertising costs.

These advertising materials are supplied by Google via so-called “ad servers”. To do this, AgreeDo uses ad server cookies, from which certain performance metrics such as ads or user clicks can be measured. If you access our website through a Google ad, Google Ads will store a cookie on your PC. These cookies usually lose their validity after 30 days and should not serve to personally identify you. As a rule, the unique cookie ID, number of ad impressions per placement (frequency), last impression (relevant for post-view conversions) and opt-out information (marking that the user no longer wants to be addressed) are usually stored as analysis values for this cookie.

These cookies allow Google to recognize your internet browser. If a user visits certain pages of an Ads customer’s website and the cookie stored on their computer has not yet expired, Google and the customer may discover that the user clicked on the advertisement and was redirected to that page. Each Ads customer is assigned a different cookie. Thus cookies cannot be tracked via the websites of Ads customers. AgreeDo by itself does not collect and process any personal data in the aforementioned advertising measures. AgreeDo receives only statistical evaluations provided by Google. On the basis of these evaluations, AgreeDo can identify which of the advertising measures used are particularly effective. AgreeDo does not receive any further data from the use of the advertising material; in particular, AgreeDo cannot identify the users on the basis of this information.

Due to the marketing tools used, your browser automatically establishes a direct connection to the Google server. AgreeDo has no influence over the scope of the data collected by the employment of this tool by Google and the further use of such data, and inform you therefore according to our level of knowledge: By including Ads Conversion, Google receives the information that you have accessed the relevant part of our website or have clicked on an advertisement from us. If you are registered with a service provided by Google, Google may associate the visit with your account. Even if you are not registered with Google or have not logged in, there is a chance that the provider will find out your IP address and store it.

The legal basis for the processing of your data is Art. 6 Para. 1 (a) GDPR.

Hosting

AgreeDo cooperates with Manitu (manitu GmbH, Welvertstraße 2, 66606 St. Wendel, Germany) for hosting the website. The corresponding data in connection with the AgreeDo offer will be stored in Germany. Manitu is particularly subject to German data protection law. Management of paying user subscriptions

The management of paying user accounts (e.g. AgreeDo Premium) is handled using GSuite from Google: Google Inc. (“Google”), 1600 Amphitheatre Parkway, Mountain View, California, 94043, USA. Only the e-mail address, address and, if applicable, the reference to the Stripe customer account are stored. Through AgreeDo, users have the possibility to trigger booking processes when ordering AgreeDo Premium. As far as this is necessary for the fulfillment of the contract, data will also be transferred to the payment service provider of AgreeDo or the credit institution commissioned with the payment processing. The scope of the data is limited to the minimum necessary for the purpose of contract processing.

When paying by credit card or direct debit, payment is processed by Stripe from the payment service provider Stripe Payments Europe Ltd, Block 4, Harcourt Centre, Harcourt Road, Dublin 2, Ireland. Accounting

AgreeDo uses the service Collmex (Collmex GmbH, Lilienstr. 37, 66119 Saarbrücken, www.collmex.de) exclusively for accounting purposes. E-mail service

In the context of e-mail communication, e-mails and e-mail addresses are administered by mail servers of DomainFactory (domainfactory GmbH, Oskar-Messter-Str. 33, 85737 Ismaning, Germany, https://www.df.com). On the AgreeDo website, videos from YouTube (YouTube, LLC 901 Cherry Ave. San Bruno, CA 94066, USA). When playing the videos, the service provider may store cookies on the user’s computer.
